12/22/09: North Carolina court orders deletion of Wellstone Filters and Learned Jeremiah Hand investigation
Wellstone Filters Sciences, Inc. and Learned Jeremiah Hand sued Ms. Christine Baker for defamation and obtained a court order requiring her to delete her previous press releases as well as all research and postings about her Wellstone Filters investigation and documentary.
12/25/09: Ms. Baker, an Arizona resident, was sued by Learned Jeremiah Hand and Wellstone Filter Sciences, Inc. on 11/9/09 in a North Carolina court even though she has never been to North Carolina.
Ms. Baker believes that she never published a false allegation or conclusion, but due to the gag order, she is unable to prove that her allegations are true. She also has not been formally served according to North Carolina court rules, but without the many thousands of dollars required for representation by a competent attorney, she decided to comply with the gag order. She spent most of Christmas Day reading the lawsuit and the orders and trying to comply with the order demanding removal of her published investigation and her countless blog posts.
Due to the court’s gag order, Ms. Baker is not allowed to state what the lawsuit is about and she even had to remove the AUTHENTICATED documents, court filings and exhibits from her 2005 litigation against Wellstone Filters.
While Ms. Baker believes that she would prevail in court as she prevailed against doctor Tameira Hollander who sued her in 10/08 in Colorado to have all “references” to her deleted, it is unlikely that she has the stamina to battle companies and people with practically unlimited funds for attorneys in a court thousands of miles away. The Hollander litigation left Ms. Baker bankrupt and she suffered serious health problems due to the litigation stress.
While Ms. Baker has been an outspoken consumer advocate for over 15 years, she now realizes: “It’s just not worth dying for ...”
